Thuto AI — Terms of Service

Effective date: October 2025

These Terms of Service ("Terms") govern your access to and use of Thuto AI's website, apps, and services (the "Platform"). By creating an account or using the Platform, you agree to these Terms and our Privacy Policy. "Thuto AI", "we", "our", and "us" refers to Thuto AI (Pty) Ltd, South Africa.

1) Service overview

Thuto AI provides AI-powered learning tools, chat help, worked solutions, assessments, and study resources. Some features are free; premium features require a paid subscription. We may update, suspend, or discontinue features.

2) Eligibility & accounts

  • You must be able to form a legally binding contract under South African law, or use the Platform with a parent/guardian's consent if under 18.
  • Provide accurate information and keep your login secure. You are responsible for activity on your account.
  • We may refuse, suspend, or terminate accounts that violate these Terms or the law.

3) Subscriptions, pricing & billing

  • Gateway: Payments are processed by Paystack; we don't store card details.
  • Currency: Prices may be shown in USD for clarity, but charges are processed in ZAR (exchange rate may apply).
  • Auto-renewal: Subscriptions renew each period until cancelled. See Cancellation Policy.
  • Refunds: See Refund Policy.
  • Taxes: Prices exclude applicable taxes unless stated.
  • Trials & free limits: We may offer trials or free-question quotas and can modify/end them to prevent abuse.

4) Acceptable use

No unlawful, harmful, deceptive, scraping, mining, reverse engineering, or disruption. Don't upload malware or content you lack rights to. We may rate-limit or suspend to protect the Platform.

5) Academic honesty

Use Thuto AI for learning and comply with your institution's policies on AI use for assignments and exams.

6) User content & licences

You retain ownership of your content (questions, messages, uploads). You grant us a non-exclusive licence to host/process content to operate and improve the Platform. You may use AI outputs for personal learning, subject to law and third-party rights.

7) Intellectual property

The Platform (software, models, UI, content) is owned by Thuto AI or licensors. Except as permitted by these Terms, no rights are transferred.

8) Third-party services

We integrate services like Supabase, Paystack, and analytics. Their terms and privacy policies apply to their services.

9) Disclaimers

The Platform is provided "as is" and "as available." We do not warrant outputs are error-free, complete, or fit for a particular purpose. Use judgment and verify critical results.

10) Limitation of liability

To the fullest extent permitted by law, Thuto AI is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits/data. Our aggregate liability is limited to amounts you paid in the preceding three (3) months.

11) Indemnity

You agree to defend, indemnify, and hold harmless Thuto AI and its personnel from claims arising from your breach of these Terms or misuse of the Platform.

12) Suspension & termination

You may cancel anytime via account settings. We may suspend/terminate for breach or legal reasons. Sections that should survive (IP, Disclaimers, Liability, Indemnity) remain in effect.

13) Changes to these Terms

Material updates will be notified by email or in-app at least 30 days before taking effect. Continued use constitutes acceptance.

14) Governing law & disputes

South African law governs. Parties will first try to resolve disputes in good faith within 30 days; failing that, the High Court of South Africa (Johannesburg) has jurisdiction.
